2. Privacy Policy

This Privacy Policy explains how your personal data is collected and used when you visit the website or use the contact form. It has been prepared in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, or GDPR) and the amended French Data Protection Act of 6 January 1978 (Loi Informatique et Libertés).

2.1 Data Controller

The data controller is the website publisher identified in Section 1.1 above.

For any questions relating to personal data, please contact: sophie@dolores.contact

2.2 Data Collected, Purposes and Legal Bases

Contact form (“Contact” page)

  • Data collected: Full name, email address, telephone number, subject and message content.
  • Purposes: To respond to your enquiries and prepare a bespoke quotation for a personalised commission (creation of paintings on canvas) or for the organisation of a temporary exhibition (rental of paintings from the Dolores Collection).
  • Legal basis: Pre-contractual steps taken at your request (Article 6(1)(b) GDPR) and, in the case of general information enquiries, the legitimate interest of the website publisher in responding to enquiries (Article 6(1)(f) GDPR).
  • Retention period: For as long as necessary to process your enquiry, followed by a maximum of three years from the last exchange if no commercial relationship subsequently arises. If an order is placed, the data will be retained for the duration of the contractual relationship and then archived for the legally required retention periods (including ten years for accounting records).
  • The fields in the contact form are necessary to process your enquiry. Please do not include health data or other sensitive information in your message.

Connection and browsing data

  • Data collected: IP address, date and time of connection, pages visited and browser type. This data is collected by the hosting provider in technical log files.
  • Purposes: Website security, detection of misuse and proper technical operation.
  • Legal basis: Legitimate interest (Article 6(1)(f) GDPR).
  • Retention period: A maximum of 12 months.

Audience measurement (Google Analytics)

  • Data collected: A pseudonymous identifier stored in a cookie, pages visited, visit duration, device type, browser type, language, approximate location and source of the visit. Google Analytics 4 does not record IP addresses.
  • Purposes: To measure website traffic and understand which sections interest visitors, in order to improve the website.
  • Legal basis: Your consent (Article 6(1)(a) GDPR and Article 82 of the French Data Protection Act), obtained through the cookie banner before any audience measurement cookies are placed.
  • Retention period: A maximum of 13 months for cookies and 14 months for audience measurement data.

2.3 Data Recipients

Your data is intended solely for the website publisher. It is neither sold nor transferred for commercial purposes.

Your data may be processed by technical service providers acting on behalf of the website publisher: the hosting provider, OVH SAS (website hosting and storage of messages received), and, if you consent to audience measurement cookies, Google Ireland Limited and Google LLC (Google Analytics service).

2.4 Transfers Outside the European Union

Contact form data and connection logs are hosted within the European Union.

Audience measurement data collected through Google Analytics may be transferred to the United States, where Google LLC is established. This transfer relies on the EU–US Data Privacy Framework, recognised by the European Commission as providing an adequate level of protection, or, failing that, on Standard Contractual Clauses. Such transfers take place only if you have consented to audience measurement cookies.

2.5 Cookies and Tracking Technologies

The website uses two categories of cookies.

Strictly necessary cookies

These cookies are essential for the website to function and do not require your consent. They include, for example:

  • The website language cookie, which remembers your selected language (French, Spanish, English or Portuguese).
  • Technical session or security cookies associated with WordPress.

Google Analytics audience measurement cookies

Google Analytics uses the cookies _ga and _ga_<identifier> to count visits and page views. These cookies are placed only after you have given your consent through the banner displayed on your first visit.

You can refuse these cookies as easily as you can accept them, without any impact on your browsing experience, and change your choice at any time.

Your choice is stored for six months, and the lifespan of Google Analytics cookies is limited to 13 months.

You can also prevent Google Analytics from collecting data by installing the opt-out browser add-on provided by Google: https://tools.google.com/dlpage/gaoptout

If additional third-party resources are added in the future (such as embedded videos, social media widgets or advertising), this section and the consent banner will need to be updated accordingly.

You can also configure your browser at any time to block or delete cookies. However, some website features may not function properly as a result.

2.6 Links to Social Media

The website contains a link to Dolores’s Instagram account. This is a standard external link: no data is transmitted to Instagram unless you click on it. Once you access Instagram, Meta’s terms and privacy policy will apply.

2.7 Security

The website publisher implements reasonable measures to protect your data, including regular updates to WordPress and its extensions, strong passwords, restricted access to the administration area and a secure HTTPS connection.

2.8 Your Rights

Under the GDPR, you have the following rights in relation to your personal data:

  • The right of access, rectification and erasure.
  • The right to restrict processing and the right to object to processing.
  • The right to data portability in respect of data you have provided.
  • The right to provide instructions regarding the handling of your data after your death.
  • The right to withdraw your consent at any time where processing is based on consent.

To exercise these rights, please write to the address provided in Section 2.1, enclosing a copy of an identity document if necessary. You will receive a response within one month.

If, after contacting us, you believe that your rights have not been respected, you may lodge a complaint with the CNIL (Commission Nationale de l’Informatique et des Libertés) at:

3 place de Fontenoy
TSA 80715
75334 Paris Cedex 07
France

2.9 Changes to This Privacy Policy

This Privacy Policy may be updated to reflect legal or technical developments. The date of the latest update is shown at the beginning of this document.

Note before publication: This is a translation, not a legal compliance audit. A few points in the French original are worth checking before publishing the English version:

  • Google Analytics and international transfers: verify that the stated transfer mechanism and safeguards reflect the arrangements actually in place.
  • Cookie consent: ensure that the consent banner allows users to reject non-essential cookies as easily as they can accept them, and that the “Manage my cookies” link works.
  • Retention periods: confirm that the stated periods match the actual configuration of Google Analytics and the website hosting logs.
  • Legal terminology: “artist-author” is a close translation of the French artiste-auteur, but it is a French legal status rather than a specific UK legal category.

The English version preserves the meaning of the original, including its references to French law, rather than replacing them with UK legislation.
